Report of the Director of Neighbourhoods

To determine an application for a premises licence under section 17 of the Licensing Act 2003 for Wyld, 1 Providence Corner, 37 Pyle Street, Newport, Isle of Wight.

Minutes:

Consideration was given to the report of the Director of Neighbourhoods, providing details of an application premises Licence, received in accordance with Section 17 of the Licensing Act 2003.

 

A schedule of additional representations, received after the printing of the report, was submitted to Councillors prior to the consideration of the application.

 

Details of any proposed additional steps to promote the licensing objectives were set out in the report circulated with the agenda.

 

The Sub Committee followed the agreed procedure, which had previously been circulated to all parties prior to the meeting. After hearing the application, the Sub Committee presented the following decision and the reasons for that decision.

 

The Chairman adjourned for ten minutes to allow all parties time to read the additional Noise Management Plan that had been submitted.

 

RESOLVED:

 

THAT upon receiving the report of the Licensing Section, oral and written evidence from the applicant, responsible authorities and other persons and having regard to the Guidance issued un s182 of the Licensing Act 2003 and the Isle of Wight Council’s statement of Licensing Policy 2014-2019, the application be determined as detailed below:

 

Application:

A Premises Licence for Wyld, 1 Providence Corner, 37 Pyle Street, Newport, Isle of Wight, PO30 1XB.

Resolution:

THAT the application for a premises Licence for Wyle, 1 Providence Corner, 37 Pyle Street, Newport, Isle of Wight, PO30 1XB be granted, in accordance with the application subject to those conditions proposed by the applicant within the operating schedule and also subject to mandatory conditions specified in the Licencing Act 2003, but modified to such an extent as the Sub Committee have considered necessary for the promotion of the four licensing objectives, namely by requiring the following conditions listed below:

Conditions:

1.    The Conditions suggested by Environmental Health on page 47 of the report; and,

2.    No regulated entertainment shall take place until the internal lobby doors have been insalled;

3.    Windows and doors are to be closed and remain closed from 21:00 hours;

4.    Door supervision to be compulsory on Friday and Saturday night from 22:00 hours and at other times in accordance with the noise management plan;

5.    Noise Management Plan to be amended to reflect No entry (or re-entry) from 23:00 hours;

6.    All licensable activity ceases at midnight.

Reasons for Decision:

As per reasons given within same report in order to promote the Licensing objectives and in particular the prevention of public nuisance, and in accordance with the Isle of Wight Council’s Statement of Licensing Policy and the 2 182 guidance.

 

In reaching the above decision the Sub Committee have had regard to the Human Rights Act 1998, and in particular Article 1 of the First Protocol, Article 8 and Article 6. The Sub Committee considered their decision to be proportionate and appropriate for the promotion of the four licensing objectives under the Licensing Act 2003.

 

All parties were advised that they had a right of appeal to the Magistrates Court if they were dissatisfied with the decision, and that any such appeal had to be made within 21 days from the date of notification.
